Loaning Terms

Smartloans Integrated Services Limited (‘the company’) is a company registered in Nigeria with RC No 1757713, aimed to provide loans to Nigerians through its loan app ‘LendSafe’. The terms of Use (“Agreement”) is an agreement between you and the company via its loan app, ‘LendSafe’. LendSafe (“we”,”us” “our”, ‘Loan app’) sets out  the terms of use on how we will provide our loan service to User (‘you’, ‘your’, ‘Users’): The Loan app usage is regulated. Thus, Users are expected to comply with the terms of use guided by the provisions of Nigerian laws including Nigeria Data Protection Regulation (2019), Nigeria Data Protection Act (2023), Federal Competition and Consumer Protections Act (2021) . Please read carefully this Terms of Use for your consideration. By accessing and/or using our Services, you signify your agreement to these Terms and to be bound by them.

  1. ELIGIBILITY

To be eligible to take loan from LendSafe;

a. You must be an adult of at least 18 years of age.

b. You must show that you are gainfully employed and have the ability to refund the loan.

c.  You warrant that you have full capacity and legal right to obtain loan from LendSafe, to enter and engage in transactions.

d. You will provide to us true and accurate information.

e. You must have a bank account.

f. You must be a Nigeria and living in Nigeria to have access to our service

  • MODE OF SERVICE PROVIDED
  1. You can have access to LendSafe service by downloading the Loan App or through the website The service is available for selection by the User who is required to comply with  the terms of use as it applies to the loan app, which shall be signed by the user at the time of request of service. Please note;
  • The loan amount you are eligible ranges from ₦5,000 to ₦600,000 depending on the loan app usage and your reliability in paying back
  • We offer Flexible Repayment Plan that is convenient for Users
  • The maximum APR is 29.2% annually, or 0.08% daily.
  • Our Loan tenure is between 91 to 360 days.
  • The information of User is required to be correct and accurate to be able to provide our service to you. The information you provide for us is subject to our confirmation before we provide you our loan service.
  • For credit assessment procedure, User shall be required to input accurate details of three (3) emergency contacts into their LendSafe Account details.
  • LendSafe is a local service suitable and designed to address the needs of Nigerians and not accessible outside Nigeria.
  • Where the User violates the loaning terms before or during the period of any service or product, we are at liberty to reject the loan application and where;
  • The loan has already been approved disbursed, the application shall be cancelled and the User shall with immediate effect be expected to make a refund of the total amount of the loan together with interest and / or damages, as the case may be;
  • Where  the loan application is ended and, the User refuse settlement of the loan amount  it will be seen as an overdue account and will be transferred to the relevant department for collection/recovery;
  • Where the debt recovery team is unable to recover the loan as a result of the Users contact number and Users emergency contact number not going through, the company retains the right to initiate legal action against such User.
  • We are at liberty to approve or reject your loan application without giving any reason
  • ACCOUNT REGISTRATION PROCEDURE
  1. To get started, you need to download the LendSafe app onto your mobile phone or device. To access LendSafe’s services, you must create and manage an account within the app, where you’ll enter your personal details. You are fully responsible for maintaining the security and confidentiality of your account and its password.
  2. You are solely accountable for the use of your account. When registering, you must provide the required information, including your mobile phone number, password, and verification code, as instructed. After successful registration, you will receive your account details and can then request the business name service. Registration is free, but you must update your information if there are any changes. A secure and stable Internet connection is required for registration.
  3. You guarantee that all information you provide is accurate and valid. We may verify this information through various methods such as credit service checks, bank information verification, background checks, and other relevant sources. If we discover that you have provided false or invalid information or engaged in fraudulent activities, we reserve the right to terminate or cancel the transaction without notice and report the incident to law enforcement.
  4. You must enable location access so we can verify that you are located in Nigeria. The information you provide must be accurate and truthful, as it will be validated by LendSafe.
  5. Through your account, you can upload payment methods, manage your information, access services, and identify yourself within LendSafe. All information provided must be accurate and reliable, and it may be verified at any time. If you authenticate via social media or similar platforms, you consent to LendSafe using the public data from your account as necessary.
  6. Accounts are for personal use only and cannot be transferred. Account holders must be of legal age and capable of managing their accounts. LendSafe reserves the right to verify, suspend, terminate, or modify accounts and content for reasons such as duplication, ambiguous or incorrect information, violations of terms and conditions, third-party rights infringements, or any actions that harm our reputation or customer experience.
  7.  We will handle, collect, use, and store data in compliance with relevant laws, including Nigeria’s data privacy regulations, and according to the privacy notices provided to users.
  • Notices related to these terms and conditions will be sent to users by LendSafe via email or through their account. It is the user’s responsibility to regularly check both the app and their email to stay informed about any notifications, as deadlines are calculated from the date the notice is sent. We are not responsible for inaccuracies in the data provided by users, or for issues related to personal data management methods (such as email or account). Additionally, we are not liable for any missed queries from users.
  • USER’S RESPONSIBILITIES
  • User agrees to use the Loan App in accordance with all applicable laws, regulations, and these Terms.
  • User shall ensure that the information supplied during the registration process is correct and not misleading in anyway.
  • User’s account is for individual use and User is expected to keep his details on the loan app confidential.
  • User is expected pay all principal and interest as required within time and where the User is unable to meet up, User should communicate to Us on time when he can pay back, taking note that default fee also applies.
  • User shall refrain from using LendSafe app for fraudulent or illegal purposes and not alter the app set up for illegal usage.
  • User should update Us on time where there is changes to his/her information.
  • To use the app solely for personal purposes, such as obtaining loans or accessing information.

Breach of these responsibilities shall cause us to terminate these terms of use with the User and the User shall be liable for interest and / or damages on the total loan amount where required.

  • DATA PRIVACY

LendSafe collect and process personal information that You provide to us directly, including but not limited to, your name, contact details, financial information, and other required documents. This information is needed to enable us process your loan application, manage your account, and comply with legal obligations. We will not sell your information or share your information except where it is required by law or with our third party solely for the purpose of this transaction. We ensure to comply with Nigerian Data Protection Regulation (2019) and Nigerian Data Protection Act (2023).

Your personal information is used for the following purposes:

  1. To evaluate and process your loan application.
  2. To communicate with you regarding your application, account status, and loan servicing.
  3. To verify your identity and assess your creditworthiness.
  4. To comply with legal and regulatory requirements.
  5. To improve our services and user experience.
  6. DATA SECURITY

LendSafe implement reasonable technical and organizational measures to protect your personal information from unauthorized access, use, alteration, and disclosure. Despite these measures, no data transmission or storage system can be guaranteed to be 100% secure. You are responsible for maintaining the confidentiality of your account credentials and should notify us immediately of any unauthorized use of your account.

  •  DATA SHARING

LendSafe may share your personal information with third parties in the following circumstances:

  1. With service providers and partners who assist us in processing your loan application and providing our services.
  2. With regulatory authorities, credit bureaus, and other entities as required by law.
  3. In connection with any business transfer, such as a merger, acquisition, or sale of assets.
  4.  DATA RETENTION

Your personal information is retained with us for as long as necessary to fulfill the purposes possibly within 4-7 years depending on our continual relationship. We may also retain your data to comply with legal obligations, and resolve disputes. After the retention period, we will securely delete your information.

  •  USER’S RIGHTS

You have the right to request access to your information, information correction, or that your information with us be deleted subject to Nigerian Data Protection Regulation (2019) and Nigerian Data Protection Act (2023).

  1.  CHARGING MODE

The user authorizes and agrees that LendSafe may perform the following actions related to charge management:

  1. LendSafe is authorized to contact the emergency contacts provided by the user and attempt to seek their help in reaching out the User when the company is unable to establish contact with you.
  2. While LendSafe will not disclose the nature of its relationship with the user, we will inform third-party contacts that the user cannot be reached and request updated contact information.
  3. In the event of delayed repayment, LendSafe reserves the right to pursue legal remedies, which may include notifying the user’s account, seeking assistance from relevant entities, or initiating appropriate civil or criminal proceedings against the user.
  4. LendSafe has the right to transfer all or part of the claim to a third party, such as a collection or recovery agency. The user consents to LendSafe disclosing necessary information to these third parties for the purpose of claim recovery, in accordance with personal data protection regulations.
  5. Collection or recovery efforts will cease only after the full amount due has been paid or an agreement has been reached for a specific settlement date. If the payment arrangement is not fulfilled, LendSafe will continue its collection attempts as outlined in these terms and conditions.
  6. LIMITATION OF LIABILITY

To the fullest extent permitted by law, LendSafe and its affiliates, officers, directors, employees, agents, and representatives shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the loan or the use of our services, including but not limited to loss of profits, loss of data, or business interruption.

LendSafe shall not be liable for any actions, omissions, or failures of third parties, including but not limited to collection agencies, credit bureaus, or other service providers, even if such actions impact the user’s loan or account.

  1. USER’S INDEMNIFICATION

The User agrees to indemnify, defend, and hold harmless LendSafe, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • The user’s breach of any term or condition of the Loan Agreement or these terms.
  • Any inaccuracies or misrepresentations in the information provided by the user.
  • The user’s failure to comply with applicable laws and regulations.
  1. INTELLECTUAL PROPERTY

The screen content related to the LendSafe service and the programs, databases, networks and files that allow users to access and use their personal data belong to us and are protected by international copyright, trademark, patent law and treaties, Industrial modeling and design Unless expressly authorized in writing by us, abuse and reproduction in whole or in part of these contents are prohibited.

The site may contain links to other sites, but this does not mean that these sites are owned or operated by us. As we have no control over such websites, we shall not be liable for any content, materials, actions and / or services provided by it, as well as any damage or loss directly or indirectly caused by the use of these websites. The existence of links to other sites does not mean collaboration, relationships, approvals and LendSafe support for these sites and their content.

  1. TAX

User is  responsible for  his/her tax liability and calculation n of his/her and any other formalities that may result in the use of the personal loan service, or / and, where applicable, hereby authorizes us to withhold the corresponding tax in accordance with related tax laws.

  1. GOVERNING LAW

These terms and conditions shall be governed in all respects by the laws in force in the Federal Republic of Nigeria with notable mention, the Nigerian Constitution, FCCPC Act, NDPR (2019). NDPA (2023)as it relates to data usage, and processing of User’s data. The existence, validity, interpretation, scope or performance of any dispute arising therefrom shall be governed by applicable laws and competent courts.

The parties shall be subjective to the jurisdiction of the competent courts in Nigeria for the interpretation, performance and enforcement of this contract and hereby renounce any jurisdiction arising from their present or future residences.

  1. DISPUTE RESOLUTION

If any dispute, claim, or controversy arises out of or relates to this loan agreement, the parties agree to first attempt to resolve the issue through informal and good-faith negotiations. Should the parties fail to resolve the dispute through negotiation within 14 days, the matter will be submitted to the Lagos Multi Door Courthouse for mediation, conducted in accordance with their then-current rules. The mediation will occur in Lagos, Nigeria.

 Notwithstanding the above, either party may seek injunctive or other equitable relief in any competent court to address or prevent any actual or threatened infringement, misappropriation, or violation of the party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
